Interpretation of Supervision Mode of Imported Prepackaged Food Label

What’s the Prepackaged Food:

Prepackaged food is defined as Pre-quantitative packaging or preparation of food in packaging materials and containers, which also includes pre-quantitative packaging and pre-quantitative preparation of foods in packaging materials and containers with uniform quality or volume markings within a certain limit. Food Safety Law of PRC required that imported prepackaged food should possess Chinese label. The prepackaged food should also possess the Chinese manual if it is required by law. The label and manual should comply with the requirements of Food Safety Law of PRC,other relevant laws, administrative regulations and standards of Chinese food safety.



Elements of Label:

The label of normal imported prepackaged food should indicate the food name, ingredient list, specifications, net content, production date, storage condition, country of origin, information of Chinese agent (Name,Address and contacts), and nutrients (According to the actual condition). If the packaged food doesn’t possess the Chinese label, Chinese manual or label and manual do not meet the above requirements, it may not be allowed to be imported.




The New Changes of Supervision


1.  Audit before Import

Official Regulations: The importer should be responsible for auditing whether the Chinese label of the imported prepackaged food meets the requirements of relevant laws, administrative regulations and food safety national standards. If it is unqualified, should not be imported.


Interpretation:This regulation points that the subject of the label auditing is the importer. The importer should audit the contents of label before import.


2.  Sampling during Import

Official Regulations: Cancel the label registration of label import of prepackaged food. Imported prepackaged food label as one of the food inspection items should be inspected by customs according to the relevant laws and regulations. If the imported prepackaged food would be inspected on-site or inspected in laboratory, the importer should submit conformity certification, the original and translated version of imported prepackaged food label, the Chinese label sample and other supporting documents.


Interpretation: Cancelation of registration doesn’t mean cancelation of supervision. Pre-packaged foods will still be inspected on-site or inspected by the laboratory during the import process. In addition to the label sample, the following documents should be provided:



  • 1). If the contents of the imported prepackaged food label emphasize a certain content, such as awards, certificates, legally produced areas, geographical indications and other contents, or emphasize the special ingredients, the corresponding certification materials shall be provided



2).  If the content of nutrients is marked, proof of conformity shall be provided


3). If the label contains genetically modified statement, such as “Non-GMO”, providing the test report; claiming to be  genetically modified, providing Agricultural Genetically Modified Organism Safety Certificate (issued by Ministry of    Agriculture)


4).  If the label claims to be organic food, providing the organic product certification


Specific to the label of a certain type of food, the customs staff believe that other certificates or supporting documents should be attached according to the National Standard "General Rules for the Labelling of Prepackaged Foods" (GB 7718-2011) or other standards.


3.  Supervision after Import

Official Regulations: If the customs received the report from other official departments or consumers about the prepackaged food label violates the relevant regulations. Once confirmed, it will be disposed according to law.


Interpretation: The new regulation of label inspection supervision only for prepackaged food which are imported through general trade, domestic exhibition, sample, duty-free operation (except offshore duty-free), embassy self-using, passengers carrying and supervision of prepackaged food which entry through mail, express mail or cross-border e-commerce and other methods would be executed according to relevant regulations.



New Requirement


1.  Common Food


1).The product should add Chinese label; the Chinese label on the product should be consistent with the Chinese label sample which is submitted by the importer to the customs.


2).The Chinese label which is applied on the product should be marked with the name of the food.


3).The Chinese label which is applied on the product should be marked with the ingredient list.


4).The Chinese label which is applied on the product should be marked with net content. That should be marked by the net content, the number and the legal unit of measurement. The net content should be indicated on the same display with the food name in the package or container.



2.  Foods for special dietary uses


1).The product should add Chinese label; the Chinese label on the product should be consistent with the Chinese label sample which is submitted by the importer to the customs.


2).The Chinese label which is applied on the product should be marked with the name of the food.


3).The Chinese label which is applied on the product should be marked with the ingredient list.


4).The Chinese label which is applied on the product should be marked with net content. That should be marked by the net content, the number and the legal unit of measurement. The net content should be indicated on the same display with the food name in the package or container.



3.  Health-care Food


1).The product should add Chinese label; the Chinese label on the product should be consistent with the Chinese label sample which is submitted by the importer to the customs.


2).The Chinese label which is applied on the product should be marked with the name, address and contact information of the agent, importer or distributor.


3).The Chinese label applied on the product should be marked with the date of manufacture. The date of manufacture should not be labelling, reprinted or tampering. The date of manufacture should be expressed in the chronological order. Otherwise,the date of manufacture should be indicated sequence.
